Besigye to appear before the High Court today

The hearing of a habeas corpus application for Dr. Kizza Besigye and Hajji Obeid Lutaale, initially scheduled for next week, has been moved to today at 9 AM at TWED Towers. This session marks a significant step toward transferring their cases from the military court to a civilian court, as per the Supreme Court’s directive.

The case will be presided over by Dr. Douglas Singiza. According to a notice signed by Registrar Kintu Zirintusa, official communication has been sent to the Commissioner General of Prisons, the Attorney General, and the legal representatives of Besigye and Lutaale.

Delays in the hearing were previously caused by the absence of an extracted decree from the Supreme Court regarding its January 31, 2025, ruling, which barred the trial of civilians in military courts. However, the decree was finally issued on Monday, allowing the case to proceed.

Last week, Winnie Byanyima, Dr. Besigye’s wife, filed a petition with the High Criminal Division of the Uganda High Court, demanding the immediate and unconditional release of her husband and his co-accused. Her application seeks a writ of habeas corpus, compelling the Attorney General and the Commissioner of Prisons to produce Besigye and Lutaale before the court.

The outcome of today’s hearing could set a legal precedent in Uganda’s judicial system, reinforcing the Supreme Court’s stance on civilian trials in military courts.
