High Court grants Besigye cash bail of Shs3m instead of Shs30m

High Court Judge Micheal Elubu has revised Dr. Kizza Besigye’s cash bail from Shs30 million to Shs3 million.

This morning, Besigye arrived at the High Court, Criminal Division, to hear the ruling in his application challenging the Shs30 million cash bail.

About two weeks ago, grade one magistrate, Sienna Owomugisha, ordered Besigye to pay 30 million in cash, and his sureties bonded at Shs70 million.

The opposition strongman rejected the bail.

“I consider this an extension of the injustices I’ve faced for long,” he said.

He instructed his lawyers, led by Erias Lukwago, to appeal the decision of the grade one magistrate.

In his ruling this morning, Judge Elubu observed that the amount of Shs 30 million set by Buganda Road Court as bail was harsh and excessive given the case at hand.

“Taking all circumstances of the case into consideration, it is my considered opinion that the learned trial magistrate exercised her discretion with a material irregularity when she set the bail condition at Shs30 million,” the judge said.

Besigye was arrested in May, downtown in Kampala, for demonstrating against high commodity prices.
