Court orders Bobi Wine’s brother Nyanzi to pay MP Nsereko Shs38.5m as election petition compensation

Mengo Magistrate Court has ordered Fred Nyanzi Sentamu, elder brother of National Unity Platform (NUP) president and former Presidential candidate, Robert Kyagulanyi alias Bobi Wine to pay Kampala Central Member of Parliament Muhammed Nsereko Shs38.5m as costs following his petition for a recount of the votes.

Nyanzi who lost the race with a margin of 1,023 votes petitioned court seeking to overturn the victory of his rival and incumbent legislator Nsereko. In his petition he says the elections were not free and fair which affected the final results in a substantial manner.

According to Nyanzi, the polls were marred by several irregularities such as failure to count votes in accordance with electoral laws, understating his votes, failure by the presiding officers to submit results from seven polling stations, inconsistencies in counting and tallying of votes on the declaration of result forms among other concerns.

However, the Mengo Chief Magistrate Esther Nansambu dismissed his application on grounds that Nyanzi was raising matters of electoral offences which would only be determined by the High court which has jurisdiction to entertain such.

“Justice is finally served. Court in Mengo has ruled that Nyanzi has to pay me costs of only Shs38.5m. Even if it’s small, I will oblige. Thank you, almighty God, for always fighting our battles. They use insults, we use brains,” jubilant Nsereko posted on social media.
