MP Nalukoola to appeal ruling nullifying Kawempe North Election victory

Elias Luyimbazi Nalukoola has officially filed a notice of appeal, contesting a recent High Court ruling that annulled his election as Member of Parliament for Kawempe Division North and called for a new vote.

The appeal notice, received by the Court of Appeal Registry on Monday, May 26, was filed through his legal representatives at PACE Advocates. It challenges the judgment issued by Justice Bernard Namanya of the High Court’s Civil Division, which invalidated Nalukoola’s March 2025 by-election win due to allegations of electoral malpractice and voter disenfranchisement.

“The Appellant, Luyimbazi Elias Nalukoola, is dissatisfied with the judgment of Hon. Justice Bernard Namanya… and intends to appeal to the Court of Appeal of Uganda,” the notice reads.

Justice Namanya’s ruling found that more than 16,000 eligible voters were denied their right to cast ballots in the by-election. Additionally, the court determined that Nalukoola had violated electoral law by campaigning at polling stations on voting day, contravening the Parliamentary Elections Act.

Following these findings, the High Court declared the Kawempe North seat vacant and directed the Electoral Commission to conduct a fresh election. However, Nalukoola’s appeal temporarily halts this process until a decision is made by the Court of Appeal.

The appeal is being handled by a legal consortium that includes PACE Advocates and Nyanzi, Kiboneka & Mbabazi Advocates, with the formal notice prepared and filed by PACE Advocates.
