Kasirye Gwanga sued for Shs500m over burning tractor

Kasirye Gwanga is in the dock.

Dennis Zimba Wakabi, a businessman, has dragged Brig Kasirye Gwanga to High Court in Kampala demanding compensation of Shs500m worth the tractor that the soldier set ablaze on August 12, 2017.

According to the plaint dated November 14 that Matooke Republic has seen, Zimba hired his tractor registration number UAY 759T to Andrew Muwonge and Kassim Sserugo to grade their land that was located in Lubowa in Makindye division.

But at about 3.30pm on the fateful day, when the tractor was parked on the said land awaiting fuel refilling, Kasirye Gwanga set it ablaze claiming it belonged to people trying to grab his land which Zimba refutes.

“That as a result of the defendant’s [Kasirye Gwanga’s] malicious and illegal acts, the plaintiff’s [Zamba’s] above described tractor was damaged beyond repair and as such it is no longer fit for purpose as per the designed usage,” read the plaint in part.

According to Zimba, who is represented by his lawyers, M/S Newmark Advocates,  he has since lost a daily income of Shs500,000.

As a result, he demands a declaration from court that Kasirye Gwanga’s action were malicious and should also pay 9950 euros (about Shs 42m) and Shs 17.2m for special damages.

“Damages for loss of income at the rate of Ugx 13m from the 12th of August till payment in full.”

 

Averagely, if the damages are awarded, Kasirye Gwanga will pay over Shs500m which include the cost of the tractor itself and other damages related to the case.

By press time, Kasirye Gwanga could not be reached for a comment.
