Kenyan lawyer runs to court seeking to have First Son Muhoozi charged with treason for his comments about Kenya

Kenyan lawyer Apollo Mboya has filed a case at the Milimani Law Courts in Nairobi asking for First Son and former Land Forces commander Gen Muhoozi Kainerugaba to be charged with treason.

In the petition, Mboya draws attention to Muhoozi’s social media comments threatening to launch a military invasion to seize Nairobi, which he claims poses a threat to the territorial integrity of the nation.

“That Muhoozi Kainerugaba, the 3rd Respondent who is a Senior Military Officer in the neighbouring country of Uganda has committed treasonable offences of threatening national security, territorial integrity and sovereignty of Kenya after expressing his intention to launch a military invasion to capture Nairobi, the capital city of the Republic of Kenya within two (2) weeks,” reads the petition.

Mboya adds that Yoweri Museveni, Muhoozi’s father, elevated him to full general after Muhoozi made the remarks.

“The Head of State of the Republic of Uganda who is also the Commander of the Uganda Peoples’ Defence Forces (UPDF), has rewarded Lt. General Muhoozi Kainerugaba by promoting him to a full General of the Uganda Peoples’ Defense Force (UPDF) following his threats to invade Kenya thereby conferring additional capabilities to General Muhoozi Kainerugaba,” adds the lawyer.

He points out that Muhoozi has broken Penal Code Section 43 of the Kenyan constitution, which defines a treasonable felony as follows:

“Any person who, not owing allegiance to the Republic, in Kenya or elsewhere, commits any act or combination of acts which, if it were committed by a person who owed such allegiance, would amount to the offence of treason under section 40, is guilty of a felony and is liable to imprisonment for life.”

Muhoozi Kainerugaba tweeted on Monday, October 3, 2022, using his official Twitter account, “It wouldn’t take us, my army and I, 2 weeks to capture Nairobi.”

He added: “I’m happy that members of our district in Kenya, have responded enthusiastically to my tweet. It is still 2 weeks to Nairobi. After our army captures Nairobi, where should I live? Westlands? Riverside?”

Mboya requests that the application be certified as urgent and that Muhoozi be given a chance to respond based on the evidence presented.
