Lukwago, Male Mabirizi take on Age Limit ruling as Supreme Court resumes business

A seven-judge panel led by the Chief Justice, Bart Katureebe has kicked off a two-day summary hearing of a petition by lawyers Male Mabirizi, Uganda Law Society, Kampala Lord Mayor Erias Lukwago and six other opposition Members of Parliament seeking the nullification of the Constitutional Court ruling that upheld the removal of the upper age limit clause from the Constitution.

The appellants want to Supreme Court to strike the Owiny-Dollo led court ruling of July 26 last year when the Constitutional Court sitting in Mbale voted four against one, upholding the scrapping of Article 102(b) from the Constitution by Parliament.

“We want the Supreme Court to quash the Constitutional Court decision and have the presidential age limit clause of 102(b) reinstated in the Constitution,” Lukwago said while entering court premises.

Apart from the Katureebe, the other judges on the panel are Justice(s) Arach-Amoko, Eldad Mwangusya, Opio Aweri, Lillian Ekirikubinza, Jotham Tumwesigye and Paul Mugamba.

According to the Court’s Registrar, the justices will conclude the hearing on Wednesday before retiring to write their final judgment.
